There are some good lawyers and advisors out there, and if you have any assets at all I'm sure you understand the importance of getting good advice from a professional.  Unfortunately however, many estate plans are written by jack-of-all-trade types who do a divorce for one client, a contract for another client, personal injury cases for others, and maybe an estate plan or two every so often.  Some are even written by non-lawyer financial planners who think they are doing their clients a favor by putting names in the blanks of generic forms they got off the internet (no kidding!). 


I recently reviewed a trust written for a family with a rather large estate. The cover letter from the lawyer promised that the trust was designed to protect the client's assets from estate taxes.  The problem was that nowhere did the trust as drafted make any provision for estate tax avoidance.  It looked like nothing more than a cheap office supply store form that the lawyer marked up by 10,000%.


Not too long ago, another gentleman came to see me about his estate plan. The problem was that he had invested his retirement savings in such a way that his family was going to pay over $150,000 in unnecessary taxes if he died before his investment 'matured'. His lawyer didn't even ask about the investment, and his investment "advisor" walked away with a $25,000 commission.  Meanwhile he was stuck with something that did nothing but compromise his estate.
